Houses of Dalits demolished by members of Upper Caste in U.P.; NHRC issues to the State Government New Delhi, October 17th, 2012 The National Human Rights Commission has issued a notice to Chief Secretary, Government of Uttar Pradesh to submit report within four weeks into allegations made in the news report that four houses belonging to Dalits in Bhita Village in Allahabad were demolished by members of upper caste. Reportedly, the assailants took away the steel, cement and other construction material lying there. They also injured five Dalits when they tried to oppose them. Allegedly, the police did not register an FIR, when members of Dalit community approached them. The Commission has observed that the content of press report, if true, raise a serious issue of violation of human rights of Dalits. The news report was forwarded to the Commission by a complainant.

     Whereas the Complaint/Intimation dated 10/10/2012 recieved from DR. LENIN, EXECUTIVE DIRECTOR in respect of REENA DEVI,URMILA DEVI,MOHAL LAL,PHOOL CHHARI DEVI was placed before the Commission on 17/10/2012. And Whereas upon persuing the Complaint the Commission has passed the Following order: Dr. Lenin, General Secretary, Peoples' Vigilance Committee on Human Rights, vide his letter dated 26.9.2012, has forwarded a newspaper report captioned, "Dalit Basti Par Dhawa Bol Char Makan Dhaai" that appeared in a local newspaper, 'Jansandesh Times', dated 15.7.2012. He requested appropriate action in the matter.

The press report alleges that four houses belonging to Dalits in Bhita Village in Allahabad were demolished by members of the upper caste. The assailants took away with them the steel, cement and other construction material lying there on a tractor trolley in the presence of police. The members of the upper caste also injured five members of the scheduled caste community when they tried to oppose them. It is also alleged in the report that the police did not register an FIR, after it was approached by the victims. The contents of the press report, if true, raise a serious issue of violation of human rights of Dalits. Issue notice to the Chief Secretary, Government of Uttar Pradesh and the District Magistrate, Allahabad to submit a report in the matter within four weeks.

Now therefore take notice that you are required to submit the requested information / Report within from the date of reciept of this notice. It is impossible for Jagesari Devi (32), a tribal woman of Sonebhadra district, to forget the fateful day when she became a victim of witch hunting and her tongue was chopped off. She was branded a 'dayan' (witch) by a local 'ojha' (sorcerer). Though her wounds have healed, the scars remain forever. The unforgettable nightmare has rendered the Holi festival colourless for her.

 

"Am I really a dayan," wonders Jagesari, and following this inhuman act of others, today she can neither speak properly nor can eat or drink with ease.

 

Witch hunting is still prevalent and brutally practiced in the twenty-first century in the rural part of India. Almost every other day, a woman is branded a witch or victimised for witch-hunting in the hinterlands of Uttar Pradesh, where Government and NGOs deliberately keep mum on that issue. PVCHR came to know through local dailies and activists that witch hunting are committed in the remotest corner of the State as it is practiced in Mayourpur block of Dudhi tehsil in Sonebhadra district of Uttar Pradesh.

 

To probe into the fact that women branded ‘witch’, then a squad of the psycho therapist reached Mayourpur and provided the psychological support through testimonial therapy to the victimized women. They badly need to regain their dignity and honour through a form of social recognition in which their private truth is openly recognised and becomes public truth, and their suffering is acknowledged and becomes part of social memory. A general silence often surrounds political repression, as if it only exists in the minds of the survivor, but the narratives of the survivors will preserve history.

Mayourpur, a place which is quite economically backward, where people have almost no access to the basic necessities of life be it education and health care. In this kind of situation, people tend to be steeped into obscurantism and superstition. And anything bad that might befall these villagers like bad crop, diseases, sudden and unexplained death of someone in the family, or drying of well tend to be considered the work of some evil ‘witch’. Thus begins a witch hunt to locate the person responsible. When daughter of Jagesari’s brother-in-law Sahdev died due to illness on August 1, 2010, she went to Sahdev’s house to condole the death, she saw that an ojha present there. He started branding Jagesari as a dayan (witch) and made her responsible for the death. The villagers gathered for the burial stood as mute spectators and her tongue was slashed as punishment. 

 

 

Manbasia (45) is another woman who has been subjected to inhuman ordeal in Ghaghari Tola Sahgora village, under Babhani police station, in Myorpur block of Sonebhadra district. After the demise of a boy in the village, she was not only attacked with sharp weapons but also paraded naked in public on July 17, 2010. "I was not a dayan, then why was I paraded naked?" she questioned. Her husband Jodhilal said he had to mortgage his land for his wife's treatment.

 

The frequency of such assaults and the dismal conviction rate, despite the existence of the Prevention of Witch Practices Act, has terrified victims into a silent acceptance of the cruelty.   Some of the most common concerns in relation to witch hunting are that in very few cases have the authorities actually responded to the complaints, and witch hunting is severely under reported, poorly investigated and prosecuted with negligible rates of conviction. The police often do not register FIRs.

 

The easiest way to grab a woman’s property in rural hinterland is to brand her a witch. Unbelievable but horrifically true in 21st century India, women in the interiors of states are beaten, paraded naked, disgraced, ostracised and then robbed of their land by anti-social elements and sometimes even greedy relatives. Witch hunting is a tool to oppress the critical thinking and wider participation of women in decision making process in the patriarchal society. In our Bhojpuri language they are called as Kan – Dayan (initial form of witch hunting).

 

However, the conviction rate for witch hunting crimes is dismal. The perpetrators, in most cases, are male relatives and their motive is to usurp the property of single women. The modus operandi is to disgrace and ostracise the victim. "

 

The fact is that it is not superstition that is at the root of many of these accusations of witchcraft but socio-economic factors: land-grabbing, property disputes, personal rivalry and resistance to sexual advances. In many cases, a woman who inherits land from her deceased husband is asked to disown the land by her husband's family or other men. If she resists, they approach the Ojhas and bribe them to brand her a witch. This strategy of branding a woman a witch is also used against women who spurn the sexual advances of the powerful men in the community.

 

PVCHR organized honoured these women on 10^th March, 2011 on the death anniversary of Savitri Bai Phule[iii] known as Bharti Mahila Mukti Diwas. The honour ceremony was organized in the Varanasi city and it was riskier in the village. The objective of the ceremony was to get them to resettle back into village.

 

PVCHR immediately intervened and sent the testimonies to the National Human Rights Commission (NHRC), New Delhi and Director General of Police (DGP) Lucknow to draw its attention towards this social evil and get victims of witch hunting some justice, Mr. Deepak Kumar, Superintendent of Police, Sonbhadra in a vide letter no. एस /शि - 26 ए/11 dated 9th May 2011 directed to be vigilant in preparing a list of actors, who brand women as witch, especially the Ojha, Sokha and the others involved in this type of activity. It requested to hold regular meetings with an effort to create awareness against the practice of witch hunting.

 

On 25^th September, 2011 PVCHR wrote open letter to Prime Minster of India[iv] and demand for a national legislation and special empowerment programme for the women in the witch hunting- prone area and awareness campaign to promote education and health.

I want to bring in your kind attention towards regarding appointment of women member in National Human Rights Commission (NHRC), New Delhi after the retirement of Shri P.C Sharma, former member NHRC. In the past, the NHRC had women members, namely, Justice Fathima Beevi (1993) and Justice Sujata Manohar (1999). At present, however, no woman sits as member of the NHRC.

Therefore it is a kind request to appoint women member from the disadvantage group or minority for achieving plurality and diversity among the commission. The process of appointment must be totally transparent and not restricted to only retired Judges or Chief Justices of the Supreme Court or to former bureaucrats – IAS, IPS, IFA, or IRS, etc., but must be expanded to include the great wealth of India’s moral, intelligent, and dedicated leaders.

हिरासत मे की गयी पहल और पैरवी – एक गश्त

उत्तर प्रदेश के वाराणसी जनपद स्थित चोलापुर थाने के 2 दरोगा और 7 पुलिसकर्मी 20 मई, 2012 को रात 12 बजे अपने जीप से गांव फकीरपुर पहुंचे और 39 वर्षीय पन्नालाल चौहान, पुत्र – स्व0 बसंतु चौहान को घर से जबरदस्ती उठा ले गये ! अगले सुबह जब पन्नालाल के परिजन थाने पहुचे, तब वहा कहा गया की आज इसका चालान कर देंगे, वही उससे मिलना, यहा मुलाकात नही हो सकती, लेकिन उस दिन चालान नही किया गया, परिजन कचहरी मे शाम तक इंतजार ही करते रह गये ! अचानक 22 मई, 2012 को लगभग 10 बजे दिन मे सूचना मिली की पन्नालाल बेहोश है तथा उसकी हालत चिंता जनक बनी हुयी है, जिसे पुलिस द्वारा वराणसी शहर स्थित “पंडित दीन दयाल उपाध्या अस्पताल” मे गम्भीर हालत मे भर्ती कराया गया है !

 

 जब पीडित के परिजन वहा पहुचे देखा की पन्नालाल के नाक – मुह मे मास्क लगा है और सलेण्डर से कनेक्ट है ! वहा के डाक्टर ने पीडित को “सर सुन्दर लाल अस्पताल” काशी हिन्दू विश्वविद्धालय, वाराणसी रेफर किये, लेकिन पुलिस - खुद S.O. चोलापुर जबरदस्ती एक निजी अस्पताल “शुभम” जेल रोड, मकबूल आलम रोड, वाराणसी मे भर्ती कराये और परिजनो से मिलने नही दिया गया ! परिजन थक - हार के क्षेत्राधिकारी, पिण्डरा से इस बाबत मिले, उन्होने कहा – “चिंता नही करो, जितना पैसा खर्च होगा, हम उठायेगे. तुम लोंग कही भी लिख – पढी नही करोगे !” वहा से उदासीन परिजन अस्पताल पहुंचे, वहा अगर कोई मिलने जाए तब पुलिसकर्मी पहले कहते – “कागजात पर हस्ताक्षर कर दो, और ईलाज कराओ !” परिजनो के मना करने पर जबरदस्ती पर उतर आये, जिस कारण लोंग किसी तरह से पीछा छुडाकर छिपने हेतु भागे – भागे फिर रहे थे ! परिजनो के द्वारा लगभग 12 बजे मानवाधिकार जन निगरानी समिति, वाराणसी मे फोन आया और वे लोंग सारी स्थिति से अवगत कराये ! जिस पर दो कार्यकर्ता को परिजन से मिलकर आगे की कार्यवाही हेतु सम्पर्क करने को कहा गया !

 

सम्पर्क साधने के बाद परिजन के तीन लोंग साथ आये, लेकिन काफी डरे हुए, उन्हे शक था की हमलोंग कही पुलिस की साथी हो ! लोंग एक - एक करके पहुंचे, कुछ भी कहने से पहले बेचैन हो ईधर – ऊधर देखते, बात कहते - कहते हमलोंगो के कार्यालय की स्थिति की जानकारी लिये ! वहा के निवासी जिन्हे वे जानते थे उनके बारे मे पूछा की आप लोंग उन्हे जानते है, इस तरह से जब विश्वास हुआ तब अन्य लोंग भी वहा पहुचे, इशारो से उन्हे बुलाया गया था ! विश्वास और औपचारिक बाते होने तथा सारी घटना सम्बन्धित तथ्य पर चर्चा के बाद वे लोंग बोले – कहा बैठा जाय ! वही समीप मे स्थित “आर्य समाज स्कूल” मे बैठा गया, जहा परिजन का बयान लिखा गया और विडियो बयान हुआ, इतना होने के बाद भी वे लोंग सशंकित थे ! कभी आवेदन लिख शिकायत नही करने को कहते, कभी कहते – “मेरा परिवार के सद्स्य के साथ यह घटी है, बिना कसूर के उसके साथ पुलिस ने अत्याचार किया है, हम लोंग भागे भागे फिर रहे है, फिर भी उसकी जान बचानी है !” उसी मे एक परिजन ने किसी प्रकार का बयान देने से इंकार किया, केवल बोले – “हा, यह सही है, उसके बच्चे अभी छोटे है, घर का ईकलौता कमाऊ आदमी के साथ यह हुआ है, अब हम क्या बोले, लेकिन मेरा बयान कही भी प्रयोग नही करे ! हमे पुलिस से बहुत डर लगता है, मै इसमे फसना नही चाहता !” काफी बातचीत होने के बाद वे लोंग फिर अस्पताल जाकर पीडित के स्थिति के बारे मे जानने की उत्सुकता जताये ! उनका कहना था की हमलोंग वहा नही जा सकते, अगर पुलिस पहचान के पकड लिया, तब जबरदस्ती हस्ताक्षर करके हम गरीब पर ईलाज के लिए सौप देंगे, वह अस्पताल सबसे महंगा है, हमलोंग कहा से लाखो रूपया लायेंगे !

 

मेरे पन्ना को पुलिस वाले जिस स्थिति मे ले गये थे, उसी स्थिति मे हमे वापस करे और हमलोंगो को कुछ नही कहना है ! उन्हे अस्पताल की स्थिति के बारे मे बताने के लिए वहा से कार्यालय होते हुए शुभम अस्पताल पहुंचे, इस बीच कार्यालय से राष्ट्रीय मानव अधिकार आयोग, नई दिल्ली – भारत को त्वरित कार्यवाही करने और सुरक्षा हेतु प्रार्थना – पत्र लिखाकर 2:08 PM पर फैक्स किया गया, जिस पर 26 मई, 2012 को वरिष्ठ पुलिस अधीक्षक, वाराणसी को नोटिस जारी की गयी ! अस्पताल पहुचने पर देखे की C.O. व S.O. की गाडी खडी थी ! मुख्य दरवाजा से ICU तक पुलिस के जवान मुश्तैद थे ! सबसे पहले रजिस्ट्रेशन डेस्क पर पन्नालाल के सन्दर्भ मे तथा उसकी स्थिति के बारे मे पूछा गया, वहा बताया गया की उनकी नाज़ूक स्थिति को देखते हुए ICU मे भर्ती कराया गया है, अभी वे बोलने की स्थिति मे नही है, अभी तुरंत मजिस्ट्रेट साहब (SDM) उसकी स्थिति देखकर गये है ! वहा से तुरंत ICU के तरफ बढे ! भवन के मुख्य दरवाजा से किसी को बिना परिचय के अन्दर नही जाने दिया जा रहा था ! दरवाजा पर खडा व्यक्ति से जब पन्ना के बारे मे पूछा गया, तब उसने कहा – उसकी हालत बोलने लायक नही है, क्या करेंगे मिलकर, आप लोंग उसके परिजन है !” अपना परिचय मानवाधिकार कार्यकर्ता कह कर दिया गया तथा साथ मे कहा गया की S.O. साहब से मिलना था, क्या अभी वे यही है !

 

कर्मचारी बोला – बता नही सकते, वे तो खुद दवा लाने मे व्यस्त है, बार – बार आ रहे है, जा रहे है ! वहा की स्थिति को देखकर लगा की पूरा अस्पताल के कर्मचारी घटना से अवगत है ! फिर भी एक कोशिश किया गया और S.O. से मिलने की बात करते हुए थोडा जबरदस्ती कर दरवाजा के अन्दर प्रवेश किये, उस समय किसी पीडित के परिजन प्रवेश कर रहे थे, जिससे यह सम्भव हुआ ! ऊपर चिढी से चढते समय कर्मचारी बोला – देखिए, वहा किसी को जाने का आदेश नही है ! ठीक – ठीक कहते हुए जब ICU मे प्रवेश किये, वहा दरवाजा पर एक तथा अन्दर दो पुलिस जवान अपने हथियार संग खडे थे ! वहा उंसेसे बात न कर कर्मचारी से पन्नालाल के बारे मे पुछे ! पहले तो वह अचम्भित नज़रो से देखते हुए बोला – “आप लोंग यहा कैसे,” तभी बाहर तैनात जवान के साथ सभी पुलिस कर्मी भी घूरने लगे ! S.O. साहब नही है क्या, कहते हुए पन्नालाल कहा है देखना चाहते है और कमरा की तरफ बढने लगे की वही कर्मचारी बोला – वह ठीक है अभी, डाक़्टर के आदेश के बिना आप लोंग अन्दर नही जा सकते, किसी को अन्दर जाने का पर्मिशन नही है, कुछ पत्रकार आये थे बाहर से मिलकर गये ! किसी तरह से उन्हे बाहर से देखकर नीचे आये ! उनके मूह मे मास्क और छती से पाईप जुडा हुआ था, वहा का हालात देख कर लग रहा था की युद्ध स्तर पर पीडित के परिजन को खोजा जा रहा है !

 

 

  इसी बीच कई बार परिजनो का फोन आया की S.O. फोन कर दबाब बना रहे है की पन्ना की देखभाल तुम लोंग करो, नही तो बहुत बूरा होंगा, तुम सभी को बर्बाद कर देंगे ! दुसरी तरफ ग्राम प्रधान पर भी दबाब बना रहे है की परिजनो को समझा – बुझा के किसी प्रकार अस्पताल लेते लाओ ! प्रधान जी भी चुप्पी साधे है ! बाहर जाने पर S.O. आते हुए दिखयी दिये, उनके हाथ मे दवाओ से भरी पालीथीन थी, जिसे वे ICU मे पहुचाकर नीचे आये ! उनके कुछ समर्थक लोंग धीरे – धीरे बात करने लगे तभी वे कही फोन लगाये, वे अलग हट के फोन किये और धीरे – धीरे बातचीत हो रही थी की अचानक थोडी जोर – जोर से बात होने लगी - “देखो तुमलोंग अच्छा नही कर रहे हो, जितना खर्च होगा हमलोंग देख लेंगे, लेकिन आकर पन्ना को देख - रेख करो !” भन्नाकर उन्होने फोन रखा और समर्थको से बातचीत करने लगे ! तभी उनसे पीडित के हालत के बारे मे पूछे, उन्होने कहा – ठीक है ! वे यह नही पूछे की आप लोंग कौन? वहा से बाहर आकर परिजनो और समिति को स्थिति से अवगत कराया गया ! इस बीच पीडित के परिजन महिलाओ को छोडकर रात भर घर से बाहर रहने को मज़बूर थे, क्योकि कई बार पुलिस द्वारा गांव जाकर खोजबीन की जा रही थी ! दुसरी तरफ परिजनो से व परिजन खुद फोन से हर सूचनाओ का आदान – प्रदान करते रहे ! अगले दिन 23 मई, 2012 को माननीय मुख्यमंत्री, पुलिस महानिदेशक - उत्तर प्रदेश व राष्ट्रीय मानव अधिकार आयोग को परिजन के बयान, विडियो बयान व अन्य कागजातो के साथ त्वरित कार्यवाही हेतु आवेदन पत्र डाक द्वारा भेजा गया ! जिस पर दिनांक 11 जुलाई, 2012 को पुलिस अधीक्षक, वाराणसी को नोटिस जारी का गयी है ! तभी सूचना मिलने पर की पन्नालाल को पुलिस वाले अस्पताल से डिस्चार्ज कराने वाले है ! शाम को अस्पताल गये, जहा कई प्रदेश सत्ताधारी राजनीतिक पार्टी के झण्डा लगी चारपहिया खडी थी, पुलिस का जीप भी आ रही थी - जा रही थी ! रजिस्ट्रेशन डेस्क पर जाकर पूछा गया की पन्नालाल को डिस्चार्ज कर दिया गया है , क्या? – वह अब कैसा है ! जबाब मे सुनने को मिला की नही, कागजात सब तैयार है, बस करना ही है, हम नही बता सकते की कैसा है, हा अब बोलने लगा है !

 

वहा से लौट कर मुख्य दरवाजा पर खडे होकर स्थिति पर नज़र रखे रहे, जहा तक सम्भव हुआ वहा जा जाकर पन्नालाल को ढूंढे, लेकिन कही नज़र नही आया ! उनके परिजन भी कही दिखायी नही दे रहे थे ! स्थिति देखकर लग रहा था की कही पन्नालाल का देहांत तो नही हो गया है, क्योकि सभी पुलिस वाले बेचैन इधर उधर घूम रहे थे ! S.O. कभी जीप से आ रहे थे जा रहे थे ! कल ICU के बाहर तैनात सिपाही कभी कभी घूर कर देख रहा था ! जीप मे बैठे दो पुलिसकर्मी के नज़र देख लगा रहा था की वे गतविधि पर नज़र गडाये हुए है ! समर्थको की गाडी का आना - जाना बना रहा, S.O. से बातचीत करके, हालात के बारे मे जान कर चले जाते ! कई गांवो के ग्राम प्रधान भी वहा उपस्थित थे जो थानाध्यक्ष के साथ लगे हुए थे ! इन सब मे 10 बजे रात गुजर गयी, लेकिन पीडित कही नज़र नही आया ! कुछ समय बाद पता चला की चुप्पे से वे लोंग निकल गये, और पन्नालाल के गांव फकीरपुर मे ग्राम प्रधान को सुपुर्दगी मे दे दिए और इलाज मे प्रयोग आने वाली दवा को रख गये, लेकिन इलाज के पर्चाओ को अपने साथ ले गये, जबकि उपस्थित परिजनो के द्वारा पर्चा मांगी गयी थी, S.O. पर्चा देने से साफ इंकार कर गये ! जब पन्नालाल की स्थिति देखी गयी, उनके सीने पर टेप लगा था, जहा एक छेद दिखा ! उनकी स्थिति उस दौरान भी गम्भीर थी, जिन्हे पुन: सर सुन्दर लाल अस्पताल, काशी हिन्दू विश्वविद्धालय भर्ती कराया गया ! काफी कमजोरी के कारण बोल नही पा रहे थे ! आज भी उनकी स्थिति दयनीय है, पूरा परिवार आर्थिक रूप से ग्रस्त है, इलाज मे काफी पैसा खर्च हो रह है !

 

पुलिस द्वारा सुपुर्दगी के बाद फिर अभी आर्थिक सहायता प्रदान नही कराया गया ! इन स्थितियो के बाद मनोवैज्ञानिक कार्यकर्ता के द्वारा स्व0 व्यथा कथा द्वारा मनोवैज्ञानिक उपचार कर मनो – सामाजिक सहयोग किया गया है ! जिससे सब्बल प्राप्त कर संघर्षरत है ! इस घटना मे 19 मई, 2012 को पन्नालाल के पडोसी के साथ नाली के पानी को लेकर विवाद हुआ था, पुलिस आकर दोनो पार्टी को गांव के बाहर ले जाकर बातचीत कर छोड दिये थे ! विपक्षी के साथ मिलकर पुलिस षड्यंत्र के तहत घटना की रात पीडित को आधी रात मे घर से उठा ले गयी और हिरासत मे अत्यधिक मारपीट के कारण पन्नालाल बेहोश हो गया, जिसे 22 मई, 2012 को वाराणसी स्थित दीन दयाल उपाध्याय अस्पताल मे आनन – फानन मे भर्ती कराया गया था ! विदित हो की पुलिस द्वारा धारा 151 Cr.PC के उस दिन पीडित का चालान किया गया और SDM द्वारा PB पर छोड दिया गया, जो पीडित के अस्पताल मे भर्ती के दौरान हुआ !

महोदय / महोदया,

हम आपका ध्यान विषयक के सम्बन्ध मे आकृष्ट कराना चन्हुंगा, जिन्हे राज्य - उडीसा, जिला - केन्द्रपडा, थाना - राजनगर के पुलिस कर्मी ने लाढी से मार - मार कर बेहाल लर दिया, जिसे स्थानीय अस्पताल मे भर्ती कराया गया है ! 

 

विदित हो की आपसी झगडा होने के बाद विपक्षी द्वारा थाना मे रिपोर्ट किया गया, जिस पर पीडित के पिता को पुलिस उठा कर ले गयी, वहा सभी गांव वालो के सामने समझौता हो गया, लेकिन एस. आई. ने नाबालिक लडके को भी थाने मे हाज़िर करने के लिए दबाब बनाये और पुलिसकर्मियो को भेजे ! पुलिस कर्मी पीडित को थाना उठा ले आये !

वह अभी अपनी आपबीति बता ही रहा था की एस. आई. वही रखी लाठी से बच्चे पर लाठी का बरसात कर दिया, जिससे वह वही निढाल हो गया ! वहा पर उसके पिता और गांव के कई लोंग उपस्थित थे ! 

 

समझौता होने वाली स्थिति मे पुलिस द्वारा यह कहर ढाया गया, जो पुलिस की क्रूरता को दर्शाती है ! 

 

महोदय, किसी भी नाबालिक को थाना मे हाज़िर करना या करवाना गैर कानूनी कृत्य के साथ ही किशोर न्याय अधिनियम का उल्लंघन भी है, यहा तो बच्चे के साथ सार्वजनिक रूप से पिटाई कर बेसुध कर दिया गया !

अत: आपसे अनुरोध है की मामले मे त्वरित हस्तक्षेप कर न्याययोचित कानूनी कार्यवाही करते हुए पीडित व परिजनो एवम गवाहो को सुरक्षा के साथ मामले मे उचित मुआवजा प्रदान कराने की कृपा करे !

Dear Sir/Madam,

 

Greetings from PVCHR

 

I want to bring in your kind attention towards regarding appointment of women member in National Human Rights Commission (NHRC), New Delhi after the retirement of Shri P.C Sharma, former member NHRC. In the past, the NHRC had women members, namely, Justice Fathima Beevi (1993) and Justice Sujata Manohar (1999). At present, however, no woman sits as member of the NHRC.

Therefore it is a kind request to appoint women member from the disadvantage group or minority for achieving plurality and diversity among the commission. The process of appointment must be totally transparent and not restricted to only retired Judges or Chief Justices of the Supreme Court or to former bureaucrats – IAS, IPS, IFA, or IRS, etc., but must be expanded to include the great wealth of India’s moral, intelligent, and dedicated leaders.

Support to the survivor to improve his well-being and to again reconnect him

PVCHR in collaboration with SICHREM, a member organization of NATT organized training of trainer workshop on testimonial therapy from 5 – 15 June, 2012 at Indian Social Institute, Bangalore. In the workshop 12 participants were trained and 15 survivors were psychologically supported through testimonial therapy.

In the second week of workshop Mr. Bheema Sena, a survivor faced firing by the forest official and he now is disabled. He was financially supported with Rs. 10,000/- with support from RCT-PVCHR project.   He will use the money to start weaving fishing net. Mr. Bheema Sena belongs to tribal community known as Jenu Kuruba (Honey hunter)[i] and now these tribes are in crises.[ii]

          हम आपका ध्यान विषयक के सन्दर्भ मे आकृष्ट कराना चान्हुंगा, 18 अगस्त, 2012 को नगर पुलिसकर्मियो फुटपाथी दुकानदारो से नियमित वसूली करने पहुचे, वही एक व्यक्ति फल बेचता है जहा बेंचू सिह यादव नाम का सिपाही वहा पहुंचा और उन्होने उस दुकानदार से 50 रूपये मांगे ! मना करते ही बेंचू सिह यादव (सिपाही) का गुस्सा सातवे आसमान पर जा पहुंचा और तमतमाये सिपाही जी ने लात, घूंसो और लाठी से जमकर धुनाई किये, उसके बाद सडक पर गिराकर पीडित के सीने पर अपनी मोटरसाइकिल चढा दिये !

         मामले मे जब वहा भीड इकठ्ठा होने लगी तब सिपाहीगण वहा से खिसक गये और इंस्पेक्टर साहब मय फोर्सपहुच गये, मामला मे रफा - दफा करने की कोशिश कर खिसक गये !

        मानवता को शर्मसार करने वाली यह घटना मे लिपा पोती की जा रही है, जिससे तानाशाही प्रवृति को बढावा मिलेगा और गरीब - वंचित लोंग लोकतंत्र मे भी सामंती व्यवहार से कुचले जा रहे है !

         अत: श्रीमान से निवेदन है की मामले मे हस्तक्षेप क्रते हुए त्वरित न्यायोचित कार्यवाही करने के साथ पीडित व गवाहो को सुरक्षा प्रदान करने की कृपा करे !
